These Terms of Use ("Terms") govern your access to and use of callercore.com and the CallerCore AI phone-answering and automation service (the "Service"). By accessing the site or using the Service, you agree to these Terms.

1. The Service

CallerCore provides an AI-powered phone receptionist and related automation tools for businesses, including call answering, lead capture, appointment scheduling, messaging, and web chat. Features may change, expand, or be discontinued over time.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of any account credentials.

3. Acceptable Use

You agree not to use the Service to:

• Violate any law or regulation, including telemarketing, consent, and do-not-call rules applicable to calls and text messages.
• Send unsolicited, deceptive, or unlawful communications, or contact individuals who have opted out.
• Infringe the rights of others, transmit harmful or malicious content, or attempt to disrupt or gain unauthorized access to the Service.

You are responsible for ensuring that your use of the Service — including any calls or messages sent on your behalf — complies with all applicable laws and that you have obtained any required consents from the individuals you contact.

4. Fees and Payment

Paid plans are billed at the rates, intervals, and usage terms disclosed at the time of purchase. A one-time $500 setup fee applies to the current standard plans, along with the subscription fee and any applicable usage-based charges. Payments are processed by Stripe. Refund eligibility is governed by the offer presented at purchase and applicable law. We may change pricing on a going-forward basis with notice.

5. Demos and Promotional Offers

Demos and any promotional or trial offer explicitly presented by CallerCore are provided to help you evaluate the Service and may have separate eligibility, duration, or refund terms disclosed with the offer.

6. Third-Party Services

The Service relies on third-party providers for hosting, voice, messaging, AI processing, business operations, and payments. Your use of the Service is also subject to those providers' terms where applicable. We are not responsible for third-party services outside our control.

7. Intellectual Property

CallerCore and its licensors retain all rights in the Service, including software, branding, and content. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the data and content you provide.

8. Service Availability

We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to maintenance, updates, or factors beyond our control.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that every call or message will be handled without error.

10. Limitation of Liability

To the fullest extent permitted by law, CallerCore will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities, arising out of or related to the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless CallerCore from claims, damages, and expenses arising out of your use of the Service or your violation of these Terms or applicable law, including claims related to communications sent on your behalf.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or others. Provisions that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Disputes will be subject to the courts located in Spokane County, Washington, unless otherwise required by applicable law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the date above and, where appropriate, by additional notice. Continued use of the Service after changes take effect constitutes acceptance.
